1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Ongi AI emotional wellness service ("Service"). By accessing or using the Service, you agree to be bound by these Terms. These Terms define the conditions, procedures, rights, obligations, and responsibilities between the Company and the user.

For users outside of South Korea, all payment processing is securely handled through authorized payment providers (e.g., Apple App Store, Google Play, or Stripe).

2. Age Restrictions

The Service requires users to be at least 14 years old (or older in specific jurisdictions as described below). You represent and warrant that the information you provide during registration, including your age and location, is accurate. Any misrepresentation may result in immediate account termination.

Republic of Korea

Users must be at least 14 years old. Registration by children under 14 requires verifiable consent from a legal guardian in accordance with applicable laws. Unauthorized registrations will result in immediate account restriction.

United States (COPPA)

You must be at least 13 years old to use the Service.

UAE (Child Digital Safety Law)

You must be at least 18 years old to use the Service in the UAE. Users under 18 are not permitted to create an account. Unauthorized accounts will be terminated immediately.

3. Acceptable Use

You agree not to use the Service to harm others, generate illegal or harmful content, impersonate anyone, disrupt our systems, or share account credentials. We reserve the right to suspend or terminate accounts violating these rules without prior notice.

COMPLIANCE WITH UAE CYBERCRIME LAW

YOU AGREE NOT TO USE THE AI SERVICE TO GENERATE, TRANSMIT, OR PROMOTE CONTENT THAT VIOLATES UAE PUBLIC MORALS, ISLAMIC VALUES, OR FEDERAL DECREE-LAW NO. 34 OF 2021 ON COMBATING RUMORS AND CYBERCRIMES. YOU ARE SOLELY RESPONSIBLE FOR ALL PROMPTS AND INPUTS GENERATED USING YOUR ACCOUNT, AND ONGI ASSUMES NO LIABILITY FOR USER-GENERATED VIOLATIONS.

4. Service Provision and Modifications

Free users may use the Service without limits for 3 days from registration, and up to 3 conversations per day thereafter (paid subscription terms are announced separately).

The Company may modify the Service to ensure smooth operation. For significant changes or service suspension, users will be notified at least 7 days in advance (or 30 days in advance for changes that are disadvantageous or material to the user) via in-app notice or email. However, in cases of unavoidable circumstances such as uncontrollable system failures, notice may be given after the fact.

5. Intellectual Property

All intellectual property rights in the content provided through the Service belong to the Company. However, the rights to emotional records and conversation content created by the user belong to the user. The Company processes such content only for the purpose of providing the Service.

6. Medical Disclaimer & Crisis Intervention

WE EXPRESSLY DISCLAIM ANY CLINICAL LIABILITY. ONGI DOES NOT PROVIDE PSYCHIATRIC THERAPY, MEDICAL DIAGNOSIS, OR TREATMENT. ONGI'S AI EMOTIONAL CONVERSATION IS MERELY A SUPPLEMENTARY TOOL TO SUPPORT PSYCHOLOGICAL WELLNESS, AND DOES NOT REPLACE PROFESSIONAL MEDICAL DIAGNOSIS, PSYCHIATRIC TREATMENT, OR THE ASSISTANCE OF QUALIFIED PROFESSIONALS. NO DOCTOR-PATIENT OR THERAPIST-CLIENT RELATIONSHIP IS CREATED BY USING THIS APP.

AI Limitations: AI-GENERATED CONTENT MAY BE INACCURATE, INAPPROPRIATE, OR LACK CONTEXT (KNOWN AS "HALLUCINATIONS"). WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR CLINICAL EFFICACY OF ANY CONTENT. RELIANCE ON ANY INFORMATION PROVIDED BY ONGI IS SOLELY AT YOUR OWN RISK.

FDA Non-Applicability: THIS SERVICE HAS NOT BEEN EVALUATED, CLEARED, OR APPROVED BY THE U.S. FOOD AND DRUG ADMINISTRATION (FDA) AS A MEDICAL DEVICE.

DHA/MOHAP Non-Applicability: NOT A DHA-LICENSED TELEHEALTH SERVICE: THIS SERVICE IS NOT LICENSED, ENDORSED, OR REGULATED BY THE DUBAI HEALTH AUTHORITY (DHA) OR THE UAE MINISTRY OF HEALTH AND PREVENTION (MOHAP) AS A CLINICAL TREATMENT OR TELEHEALTH SERVICE.

7. Limitation of Liability

The Company is exempt from liability for service interruptions caused by force majeure events such as natural disasters.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONGI, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING PERSONAL INJURY, EMOTIONAL DISTRESS, OR LOSS OF DATA) ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THE PAST SIX (6) MONTHS.

8. Dispute Resolution

United States Users

BINDING ARBITRATION: ANY DISPUTE OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL BE SETTLED BY BINDING ARBITRATION, NOT IN A COURT OF LAW.

CLASS ACTION WAIVER: YOU AND ONGI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

All Other Users (Including Republic of Korea and UAE)

These Terms are governed by the laws of the Republic of Korea. In the event of a dispute, both parties shall prioritize good-faith negotiations. If litigation is necessary, the competent court under the Civil Procedure Act (or the court having jurisdiction over the Company's principal office) shall have exclusive jurisdiction.
